As a user of this Site or our services, this Privacy Policy outlines what information we may collect about you, how we use and share that information, how you may access your information and your choices about the use and disclosure of your information. NOTICE UNDER THE PERSONAL DATA PROTECTION ACT 2010

The Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions, applies to re:mind Psychology Center (Company No. 1304353-V) (“re:mind”, “we”, “us”, “our”, or the “Company”). For the purpose of this written notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the Act.

This Notice serves to inform you that your personal data is being processed by us or on our behalf when you use our services in relation to the re:mind website (“Site”) and related applications, whether it is online or onsite services (“Services”).

1. Collection of personal information

Your personal data includes:

a. Personal details (such as name, age, gender, identity card number, passport number, date of birth, ethnicity, language, nationality);
b. Contact details (such as address, email, phone number);
c. Payment details (such as bank account, credit/debit card and other payment related details)
d. Social media details (such as Facebook, Twitter, Instagram, LinkedIn);
e. Employee Identification Details, if applicable (such as Employee ID, Job Grade, Beneficiary Coverage);
f. Appointment details (such as healthcare providers you have visited, your reasons for visits, your appointment history, and other medical and health information you choose to share with us;
g. Other information that you voluntarily choose to provide to us in registration/application forms or any other similar forms and/or any information about you that has been or may be collected, stored, used and proceed by re:mind from time to time, and includes sensitive personal data such as data relating to health or religious or other similar beliefs, unique identifiers such as passwords, and personal data in communications and correspondence emails or letters that you send to us; and
h. Additional personal or other information that may be relevant for the purposes of providing our services to you.

2. Generally, your personal data was, is being or is to be collected:

a. When you use the Services’ interactive tools and services, such as searching for Healthcare Providers, searching for available appointments with Healthcare Providers and completing medical history forms prior to Healthcare Provider appointments;
b. When you voluntarily provide information in free-form text boxes through the Services and through responses to surveys, questionnaires and the like;
c. If you download and install certain applications and software we make available, we may receive and collect information transmitted from your computing device for the purpose of providing you the relevant Services, such as information which notifies us about when you are logged on and available to receive updates or alert notices;
d. Through cookies on the Site, and website analytics services and other tracking technology; and
e. When you use the “Contact Us” function on the Site, send us an email or otherwise contact us.
f. You are responsible for ensuring that the information you provide us is accurate, complete, not misleading and is kept up to date. If you fail to supply us any of your personal data which is not stated as being voluntarily provided to us, we may refuse to process your personal data for any of the Purposes and you will not be able to use the Services.
g. We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and when you provide us with your consent, you also represent that you have the requisite consent under applicable laws to provide other person’s information to us.

3. Your Rights

a. You have the right to request access to and to request correction of your personal data and to contact us with any inquiries or complaints in respect to your personal data. You can object to the processing of your personal data or ask us to restrict processing of your personal data including other persons who may be identified from that personal data by contacting the re:mind administrative team at hello@remindpsych.co.
b. You have the right to request deletion of your personal data by contacting the re:mind administrative team at hello@remindpsych.co.

c. In accordance with the Act:
i) We may charge a prescribed fee for processing your request for access or correction; and
ii) We may refuse to comply with your request for access or correction to your personal data and if we refuse to comply with such request, we will inform you of our refusal and reason for our refusal.
Failure to provide re:mind with your personal information may result in us being unable to provide you with our Services.

4. Use of personal information

You consent to the processing of your personal data for purposes “Purposes” which include but are not limited to the following:
a. To connect you as the Client with the Service Provider that you have chosen or agreed to consult;
b. To identify your location;
c. To serve you;
d. To provide you with the relevant services;
e. To attend to the relevant transaction if applicable;
f. To facilitate our interactions with you;
g. To contact you when necessary or requested, including to remind you of an upcoming appointment;
h. For compliance with legal and regulatory obligations;
i. To send you electronic announcements and newsletters that we think will interest you;
j. To determine your eligibility, obtaining benefit plan information;
k. To perform core operational services (such as hosting, billing, fulfilment, data storage, security, insurance verification, or Site analytics);
l. To enable us to customize our advertising;
m. For internal record keeping;
n. For internal investigations, audit or security purposes;
o. To promote the Services and services provided by our related corporations, including providing you with information about our other services;
p. To investigate your complaints;
q. To produce statistical reports, at collective level, for corporate reporting, research works and publications;
r. To use statistical information that we collect in any way permitted by law, including from third parties in connection with their commercial and marketing efforts;
s. For analysis for statistical, profiling or other purposes for us to conduct category analysis, financial analysis, investigate service lapses, and to review, develop and improve the quality of our products and services; and
t. Such other purposes directly related to the foregoing (collectively, “Purposes”).
u. Generally, we handle your personal data for the purposes set out in this Notice. Any one or more of the listed purposes may apply to your personal data, depending on the actual situation. The Purposes above do not purport to be an exhaustive listing, although an effort is made to set out as many salient purposes as may be applicable.

5. Who do we disclose personal information to?

a. We disclose or may disclose your personal data for the Purposes to our related corporations, employers (where applicable), our business partners, our service providers, Healthcare Providers, insurance company, governmental departments and/or agencies, regulatory and/or statutory bodies and any such third party requested or authorized by you or as may be required under applicable law. We may also disclose your personal information to third parties involved in any corporate exercise or transactions relating to re:mind e.g. sale and purchase of assets, reorganisations or amalgamation or collaboration.

6. Third Party Sites or providers

a. Through the Site and/or the services, you may obtain access to certain third parties such as medical or healthcare practitioners, professionals or providers and other portals or applications. The privacy policies/personal data protection notices of such third parties are independent from that of re:mind’s and you should review such policies/notices carefully as the use of information disclosed to such third parties is subject to such policies/notices.
b. Our Site may contain links to and from the portals, apps or resources of our partners, advertisers and other third parties. If you follow a link to or access any of these websites or resources, please note that they have their own privacy policies/data protection notices and terms of use which you should review. We do not accept any responsibility or liability for these websites or resources and your access and use of them is at your own risk.

7. Opting out

a. You have the option to opt-out of receiving marketing communications from us and selected third parties and limiting the distribution of your personal information. You can do so by contacting us via hello@remindpsych.co or so far as applicable, by accessing your registration/account with us or by clicking on the “unsubscribe” link in certain electronic communications we may send to you.
b. When we receive your request to opt-out from receiving marketing
communication, it may take up to fourteen (14) working days for your opt-out to be updated in our records and systems. Accordingly, you may still receive marketing communication during this short period of time. Kindly be reminded that even if you opt-out from receiving marketing communication, we may still contact you for other purposes in relation to the transactions between us or the services you have requested from us.

8. Protection of personal data

a. We take the necessary security and technical measures to protect the security and confidentiality of personal data in compliance with applicable law. 

b. You should keep this information safe as you will be responsible for any action which we take in response to a request from someone using your username/e-mail and password. If you have an account with us, you can also update your personal information by accessing your account. You undertake to keep safe and not disclose to third parties your account information, including passwords. We will not be held responsible for any misuse or disclosure of access information or passwords.

9. Changes to the policy

a. We reserve the right to amend this Notice at any time and will place notice of such amendments on the Site or via any other mode that we deem suitable.
b. Nothing in this Notice shall limit your rights or our rights under the Act.

10. General

a. We may transfer your personal data to a place outside Malaysia for any of the Purposes.
b. In the event of any inconsistency between the English version and any other languages of this Notice, the English version shall prevail over any other languages.
